Is it safe -leave US without approved AP but coming back with ap

I need to go back to China tomorrow for two month, but the AP has not yet been approved, which filed at October.

My laywer said I can go and he will mail the approved AP to me, so I can take the AP back without visa. I am at H1 now.

Any somments are appreciated. thanks.
