I am sorry that I didn't make it clear before. My situation is:
I-140 for NIW was submitted on 3/2007 but it pending, NIW based I-485 also pending
EB1 submitted on July, 2007, also pending. Now the related 485 was rejected.
Apparently, my case is much worse than that JDJ mentioned. The reason I applied the EB1-based 485 was based on my thought that the EB1 application was faster than NIW-based process if both I140 is supposed to "approved". On the other hand, to be honest, I am not quite confident with my NIW application. So I am afraid if my NIW were denied, my NIW basd 485 would be rejected too. If someone can answer me this question, then my problem is solved. Is it possible to transfer my "approved" EB1-based 140 to NIW-based 485? Thank you very much.
