I don't know why you were out of status so I asked, and now I am still sort of confused. When your hu*****and went back to BJ applying H-1, you did not go with him? If my impression is correct, then what was your status before he got H-1? Normally if your hu*****and was in status, so were you as a dependent.

When you filed 2nd I-485 as a dependent, it must have been filed together with his 2nd I-485 based on his NIW I-140. If there was just one I-485 was filed, even with NIW I-140, you did not do it right.
