Xiaobaitu, please help!

My hu*****and was reported to police officers in 8/2006 for leaving our 4-year old in the car alone for about 5 minutes when going grocery shopping. The child was fine. To our surprise, 7 months later in 3/2007 my hu*****and was charged with "Child Endangerment "and arrested for two nights. With the help from our criminal lawyer he was granted diversion and ordered to take parenting counseling class. He has never been convicted and completed his parenting class in 8/2007。The lawyer said per diversion agreement with the state his case would be dismissed on 5/13/2008. We are planning on a trip to China soon with AP which we applied in August of 2007. My questions to you are the following:

Will there be any problem at Port of entry when we come back from China?
Should we wait till his case is dismissed in May to make the trip?
What information should we bring with us for his case?
