First of all, I just want to confirm that I understand you correctly. If I change job of a different nature after the approval of I-140 and the 3-year extension of H1-B, I will be legally in H-1B status after a H1-B transfer regardless whether my old employer cancels the I-140 or not. Is that correct? Then I have more more question, if you have time: Will my future GC application have to be of the same category? I am currently applying under EB3. Will I be able to apply under EB2 yet to use the same PD after the approval of the new I-140? Thanks a lot. You've been the champion for us!
