天哪！哪來的criminal history. Need Help.

My H1b pending (premium process), USCIS just emailed my lawyer that I was charged with misdemeanor assault on Oct 21, 2007. But it never happened to me. Maybe some one has the same name with me. USCIS required me provide the certified judgement and conviction document for the offence. My lawyer is writing a letter for me and he will send to USCIS after i sign it. What can I do about it? The letter can solve the problem. Thank you very m uch.
