My postdoc job in A university will be finished on 12/31/07, B university is doing the paperwork for my H1b transfer. My second postdoc job will start from 1/1/08.

1. My H1b tranfer must be sent out to USCIS by 12/31/07. If it will be sent out earlier, can I still work in A university untill 12/31/07?
- The I-129 must be received by USCIS prior to 12/31/07, and you may work for Univ A until 12/31/07.

2. B university told me that I have to wait to work until the transfer is approved. It will take 2-3 weeks. Is it true? Can I start to work from 1/1/08 or after i get the receit?
- You may expect it's longer than 2-3 weeks, say 2-3 mos. While you don't have to wait for approval notice so as to work for new employer as long as the receipt of I-129 has been issued

3. My first job will be finished on 12/31/07. If I start my second job 3 weeks later, is there a gap for my status?
- If your new H-1 is effective from 1/1/08, you have no gap.
