Ask Pjiang, Xiaobaitu and Radiology

My status is H1B and my son is H4. My H1B will be expired at 12/31/2008. Now I get an offer. The new employer will transfer my H1B. I know if the new employer apply for the new three years, I need to apply for H4 for my son. If they just extend to the end of next year, does my son still need apply H4 at the same time? Someone say I don't need to apply for my son at this time. Am I right?
