今天我們向Bruce Morrison (LIA 的 lobbyist) 谘詢了DHS/USCIS和FBI的關於name
check的改革“謠言”。Bruce說，那根本就不是什麽謠言，移民律師協會協議(AILA)已
經正式發布了改革的消息（見下文）。之所以會讓人產生誤解完全是因為ILW.COM上斷
章取義的解釋：一會兒說USCIS可以不用等name check 結束就發綠卡，一會又完全否定
自己的說法。
Bruce說實際情況是這樣的：DHS的secretary Chertoff 想要解決name check backlog
，於是采用了一種“風險管理”的方法。法律規定綠卡發放和name check 無關，隻和
finger print 有關。等name check 結束再發卡隻是USCIS的行政規定，所以他們當然
有權改動。“風險管理”的本質是：被name check 卡住一段時間（有可能是半年）以
上的案子，如果對國家安全“風險小”，USCIS可以不用等 name check clear就發放綠
卡。但是，被認為對國家安全“風險大”，則肯定要等到 name check clear 後再發卡
。這個決定最早於2008年1月1號實施。
Bruce 說，這個決定表明DHS/USCIS 解決name check backlog 一種姿態，它可能會有
效地清除name check backlog，畢竟真正威脅到國家安全的案子還是少數。但是該決定
還有可能僅僅限於一種姿態，而不是付諸行動，因為“風險”是一個非常扯的概念，怎
麽去評估，完全是USCIS/FBI說了算，而不是依照法律標準。所以，一旦USCIS由於種種
原因無力去執行這個決定，他們就會拿“風險”開扯。所以，政府部門的決議是否有效

In a meeting with AILA and other organizations, DHS Secretary Chertoff
indicated that USCIS and the FBI are changing parts of the name check
process, with the expected result that a large proportion of the backlog
should be cleared within six months. The changes are consistent with
Secretary Chertoff's risk management approach. The Secretary hopes that, in
addition to clearing the backlog, a large percentage of the kinds of
applications and situations that have previously been caught in name check
delays will, in the future, be cleared quickly. However, he cautions that
some checks still will be delayed by investigations, but that that number
should represent a small proportion of the numbers previously delayed.
