My wife and I are H1B visa holders. We have filed for I-140 and I-485, both of which are still pending. We have also received our EADs. Now my wife has this opportunity to work for another employer, who prefers to hire her as
a part-time consultant using Form 1099.
What are the risks if she uses her EAD to work for the second employer? My understanding is that once she works on her EAD, she will lose her H1B status. In that case, if I-140 was refused, will she be able to stay in the U.S? Can she change her status as my dependent(H4) then?
Sorry I can't type Chinese in the office. Would greatly appreciate any advice
you might have.
