Please can anyone help? I cannot type Chinese so bear with me with my chuppy english.
My friend owns a company and is willing to file the green card petition on my behalf. My situation is: accounting major, working in an accounting firm on H1B. I have no intention to work for my friend. He is just helping me out with my green card thing. I will pay all of the expenses which will incur during the whole process: legal expense, payroll expense, payroll related expense, etc..
My questions are:
1. Since I'm on H1B, can he hire me based on a future employment?
2. If everything goes well, after I file the adjustment for status (I485), can I be put on their payroll (in order to show that I'm hired) and not actually work for them (I'm working in an accounting firm)? Will there be any problems when I file the tax return?
3. If the I485 is pending, can I work at my current firm and be hired as a permanent employee (as advertised for the green card petition) at the same time?
4. I have no intention to work for him and he has no intention to hire me. He just helping me to get my green card done. How do you think we can surpass the existent regulation while everything is still legal and I can have my green card done?
