a. for example, if my priority date is 4/1/2006, the visa number is 4/1/2006 on 1/1/2008. but because of some reason(waive issue), both of my kid and i cannot file 485 on 1/1/2008, my kid still has to file Form 485 within one year of 1/1/2008 even if we are not eligible to file 485 because of waiver?
if because of waiver, we cannot file 485 on 1/2008 , my kid still have to file other equivalent form such as I-824 or DS 203 within one year of 1/1/2008?

But, let's see: if my priority date is 4/1/2006, on 1/1/2008, the visa number is 3/28/2006, we can file 485 in aspect of priority date. but we are ineligible to file form 485 due to waiver. and on 2/1/2008, the visa number is 5/1/2006, we can file 485 both in aspect of priority date and waiver. then which date should be used to determine teh kid's age, 2/1/2008 or 1/1/2008? should file form 485 within one year of 2/1/2008 or 1/1/2008?
