My hu*****and got an offer and his new employer is willing to sponsor H1. The problem is our J visa (4th year) will expire by mid July and our waiver is stilling pending. If we are lucky enough, the earliest possibility we get the waiver is in Sep. questions:
1. Could you tell me how to keep the period legally staying?
2. Is it possible the waiver will be denied due to the change of employer? If so, can we apply again?
3. If my hu*****and gets a better offer, can he submit two H1 applications?
4. I am working. If I continue to work after my J visa expires, how does the INS know that? My EAD card will expire next year. I know according to the policy, if my hu*****and’s J visa expired, my EAD expires automatically also. I do not know if it is worth to 鑽空子 (just for family economy purpose) and is there any effect for our future? I also want to apply H1.
Thanks in advance.
