不幸遇到不負責任的律師

各位高手：你們好 ！

我們不幸遇到一個不負責的律師，我們RIR辦的是EB3， 遞140時資料也是
按EB3準備的，但是我們收到140收據的時候發現Section 寫的是“Mem of Profession w/Adv Deg, or of Exceptn'1 Ability Sec.203(b)(2)". 再回過來查
律師他們確定的140 表格第二頁，他們選的是 d , A member of the professions holding an advanced degree or an alien of exceptional ability (who is NOT
seeking a National Interest Waiver). 簡單的說，律師把我們EB3的案子遞成EB2
了，140 收據上寫的類別也是EB2 的。

我們全家用了3年半的時間，已花費超過7000USD來辦理這次移民，現在出現這樣的低級錯誤，真是感覺到很痛苦。請教各位高手，這種情況該怎樣補救呀？？謝謝大家！！！

另外，如果我們另遞一個親屬移民的案子，人在美國，pending 期間能夠申請工卡嗎？

來美5年了，現在是進退兩難，感謝熱心人的建議！！！
