Could you please help? Apply for H1b with a H4 pending

I am currently on H4 visa, which expires as of 11/24/2007. I applied for an extention of my H4 on 11/5/2007.
I have several questons as follows:
1. May I file H1b petition (non-cap) while my H4 is still pending?
2. Should I withdraw my H4 petition, after H1b applicaton has been submitted?
3. Will I run into trouble if H4 is approved later that H1b.
