I do not think it will affect his previous case. Even he lives with you in his first marriage, it does not matter to his divorce case except speeding his divorce.

It is nearly useless to call police, if he does not break law (physical violation). If you have no court order, police can do nothing.

The only thing police can help you may be to help you move out by giving you a ride to hotel or somewhere you choose.
