May be not out of status

By law, an H-1B alien can only start to work after October 1. By the alien employee's choice, the alien can take a leave of absence (such as touring the country). During this nonproductive period, the H-1B employee does not have to be paid. However, if the employer revokes the LCA and notify the USCIS that the alien's employment is terminated, then the alien's H-1B status may be terminated.
