To be eligibel for mandamus relief, a plaintiff must establish that:(1) he has a clear rigth to the relief sought; (2). The defendant holds a plainly defined and mandatory, NON-DISCRETIONARY DUTY to do the action in question; and (3) the plaintiff has exhausted his administrative remedies and no other adequate remedy is available
