I think the main reason for you to file the case is to get GC, not to win the case, right? There are at least 100 cases where immigrants lost the lawsuit and still get their GC with in 1-2 month afterward. If you sue them, some one will start to work on your case, and your case will not be sitting in some area collecting dust. I would say go for it, no matter the chances are good or bad.
