you need to bring your H1/H4 documents to US consulate in China

and get a visa page pasted on your passport. The visa will give you 3 months entry period just like you first applied visa in China. You also need to bring 485 original receipts this time together with your H1B visa back to US.

You can not simply bring your H1B approval notice and walk through US custom without a visa stamp.Based on this, my understanding is that your lawyer is wrong or your interpretation is wrong.

Alternatively, you can just wait for AP. By holding an AP, you won't need to go to US consulate in China.

Please note that if you leave US before AP is granted, your AP will be invalid.
