請小白兔指點：When 485 is pending, can't apply O-1 visa to re-enter US

7/26 filed 140/485 cocurrently to TSC, NIW case - DIY
9/14 all receipts received, (140/485/765/131)
9/28 FP Notice, 10/17 FP appointment
10/5 EAD received

I am currently a post-doc H-1 (not subject to visa number), just received a good offer and the company wants me to start ASAP. But now H-1b visa is used up and company is willing to sponsor for O-1.

But I have a question: Just heard that if I apply for O-1 via when 485 is pending, I can't re-enter US with O-1 but must use AP? Is that correct?

I also heard O-1 visa is dual intention, same as H-1. So comfused.

請小白兔指點一下，為何O-1 status如果出了美國，並且有485pending, 就不能再簽O-1簽證回來，而必須用AP回來了呢？Why at this point it's very different than H-1?

因為最近拿到一個offer, 而H-1又沒有名額，正在考慮是要求公司辦 O-1呢，還是直接用手上的EAD開始工作？如果O-1真的是像朋友所說，不能出境 (when 485 is pending)，必須用AP的話，那一旦離美，我的身份跟我現在直接用EAD也沒區別了。這樣的話，申請O-1就沒有意義了，不如直接用EAD上班。因為我可不想在這裏耗著，直到綠卡拿到才能回國。每年總還想回國看看吧。

請小白兔等高人指點一下吧！我到底是現在申請O-1呢，還是直接用EAD去上班？用了EAD, 萬一我的NIW 被拒，還有什麽補救辦法麽？是不是我就馬上out of status 了呢？到時候還能申請O-1或者H-1麽？請給仔細分析一下。謝謝！
