As I know, a valid H-1B holder can use his/her H-1B to re-enter US from Canada, if his/her trip between US and Canada is less than 30 days.
I must go to Canada for about 1 week at the end of this December. My H-1B amendment (change job location for same employer) was just filed to VSC this week. I'm not sure if I can get my H-1B amendment approved by December.
1. Can I re-enter US from Canada, while my H-1B amendment is pending?
2. Which documents should I bring, when I re-enter US from Canada? Currently, I don't have a valid visa or I-94 card on my passport. I only have my H-1B approval notice (previous job location) with an I-94 card on it. This I-94 card is valid through 01/01/2010.
3. Do I need to turn in my I-94 card to the boarder's officer when I leave the border of US? But it's on my H-1B approval notice. I will not have a proof, when I re-enter US.
4. I'm also thinking about applying for an AP now. But while AP application is pending, I can't leave the US. Is it correct?
