求助！各位大俠!（appeal 和身份問題）先恭謝過!

我的I-140/485被拒了.原因是I-140 job posting 少一個business day. 律師說另一個和我的一模一樣的job posting（也少一個business day）被批準了.律師已filed an appeal, 但還沒file the brief。我的問題是:

1) appeal 批準的可能性有多大? brief 要如何去 argue ? 能用另一個同樣的job posting 但被批準了的 case 去argue 嗎?

2) 我的H4在I-485 pending 期間filed,被批準了.其後我拿到 EAD 開始工作.現在 I-485 被拒,我需要去美境外再簽 H-4 簽證嗎? 還是等看 appeal 的情況再說?
