Filed Concurrent NIW I140/I485 in NSC. Shipped the package by FedEx on July 26, Delivery on July 27, 2007 (have FedEx Signature Proof).
Today got I797 Notice of Rejection due to wrong filling fee of $195. So frustrated.
On the form showing the notice date of August 30, 2007. They said the fee should be $475 after July 30. In the form “Receipt” field showing a label of 08/30/2007. But when I looked my I140 form, there is a printed time stamp showing “July 27, 2007, 7PM” with a red cross line. I also have the proof from FedEx receive signature. Per USCIS FAQ#2 Q25. “The data the item is entering into the couriers’ service system will be the postmark date for fee determination purpose”.
Did I submit the correct filling fee?
Is this an error of NSC?
Should I contact NSC now to correct this? What is the standard procedure to due this kind of situation?
Will I still get a priority date of July 27, 2007 for I140/485 concurrent filling?
Should I file the case again when waiting the response from USCIS?
