Just my personal opinion

I think the RFE really means, you should prove that before the date you submitted labor certificate application, you already had the skills listed in it. The skills you learned after you submitted LC cannot be used. In this case, a working experience letter with details of your skills before your LC date should serve both purposes.
Your lawyer may be right. The only thing you need to do is to prepare a good experience letter.
Just my two cents.
