Anybody can answer?

I know if I use my EAD, my H-4 status will be valid no longer. If my spouse’s I-140 is denied, I have to leave US and get H-4 visa to be back. However, I concern I may have trouble to get H-4 approval outside of US, since the embassy officer may say I have ‘immigration intension’ if they find my I-485 was denied. I remember somebody gave his opinion here that you can continue to use H-4, since USCIS do not check if you used EAD before. Actually, I do want to know any body have met such situation before? Which is the better way to do? Your suggestion are highly appreciated!
