I searched for answer in this board but didn't see any case similar to mine.
My opt is going to expire on August 23 and my H1B is approved and will be
valid on Oct 1.
I can stay in the U.S. during the 38 days of gap. But my company wants me to
work from Beijing so my current project can be continued.
My wife is on F2 status with me and got her H4 approved together with my H1B.
My questions are:
(1) My major is Industrial Engineering with optimization background. My job
is still in the same optimzation area. I have been in the U.S. on F1 status
for 5 years without going back to China. Is there any chance that I will be
denied the visa stamp or encounter security check?
(2) If I go back to China, can my wife still stay in the U.S. legally, if so
, what would be her status? This is what I worry most.
(3) I heard that once my wife goes back to Beijing, her I797 of H4 will be
invalid. Can she apply a H4 visa stamp together with my H1B stamp in Beijing
before Octobor 1, says September? I am really confused about the H4 I797
invalid issue.
