You'd better to get a lawyer to do it since you don't know it.

1. Non-profit H1 is only for Non-profit institute or University. Does your company fit it?

2. You need apply Labor conditional certificate (or other name) firstly before you submit your H1 application. That one is applied in the department of labor in your state. It is not so hard as PERM application. So ask a lawyer firstly.
