File a stipulation to AUSA and Judge to remove that word "approval" from your original complaint. It is just a simple statement stating that you drop that word from your original complaint. You have to contact AUSA to discuss it and tell him the bottom line is that anyway you can refile your amended complaint according to rule 15.
If they don't allow you to do it, refile the complaint without that "approval" according to Federal Rules of Civil Procedure Rule 15 and name it amended complaint. This may or may not delay the hearing date.
After that, you'd better file an opposition to MTD. The court could set a hearing date to discuss MTD and your opposition.
