my current visa status is F-1(in OPT), OPT expires in the end of August, and H1-B is valid from 10/1. I have 2 month grace period after OPT expire. I plan to go back to china stay for one month during the grace period and come to Beijing embassy to apply for H-1B. In my understanding, AOS allows F-1 status continues when I-485 is pending, just that I-20 can't be extended. My OPT was approved before submission of I-485, so it is still valid when I submit I-485. I want to reenter the US with H-1B which allows dual intent, i.e. work for a US employer with nonimmigration H1B visa and also apply for immigration.

Can I go back to China in Sep during OPT grace period and come back with H1B visa and also submit I-485 with my spouse in July? Your comments would be appreciated.
