PD is fixed by RD of your 140, but I485 processing date is based on your I485 ND itself. for example, on July 16,2007, I485 processing date in TSC is August 7,2006..............
but your lawyer is right, even very strong NIW case may get denial, so you may have to think very carefully before you can reach your final decision,
If i were you i will follow what the lawyer said
