out of status or not?

我勞工的I140和I485在JUL09同時被deny,被deny時是H4身份,而且已經用了EAD,但他隨我又在這個June30遞交了一份485,receipt date應該是JUL2,這樣一來就銜接上了,請問這樣一來他是不是就沒有out of status了?謝謝!
