Hi,
I have the H-1B petition approval, too but have not seen the actual notice about my change of status to H-1B. I am facing the same gap problem and need to decide whether to change to F-2 or go back to China to apply for a H-1B visa. My concern is with F-2 -- if I file it now and get it approved, do I have to file another change back to H-1B for 10/1/04? One thing I know is that we cannot use I-539 to file scuh a change to H-1B -- one lawyer said that I need to file I-290 again through premium processing in September -- another says no, filing a F-2 will make my current H-1B invalid. I am pretty confused on this. Did your lawyer give your advice on filing F-2 and the implications for the current H-1B?
I am thinking of just going back to China for the H-1B VISA -- what's your lawyer say about the risk in doing that? Thanks!
