I just called my Lawyer about this. But her assistant(the lawyer is not available) said I can't file second I-485. If I do, the USCIS office will ask me to withdraw the first one then process the second.

More questions:

1. do you know when I filed my EB2 I-140 and I-485 concurrently, are both I-140 and I-485 processing same time or my I-485 will be processed only after I-140 approved? According to my lawyer, my I-140 needs to be approved before the I-485 will be processed except finger print, EAD...but name checking stuff will be processed after I-140 approved? Is this true?

2. Because of the above reason, I'm wondering that if I file my EB3 485 now, this EB3 485 should be processed faster that the EB2 485 since EB3 I-140 has already been approved? Is this true?

3. will the huge 485 filing now affect my EB2 485 filed in Nov. 2006? Should they be processed after mine?
