if you can receive the receipt from the INS about your H1B1 petition, even through your opt is expire, you still have the valid status,but maybe at this period you can not have the salary, but if you apply the F2 you will loose the h1b1 status,why they apply the h1b so late if your start 10/01/2004, i think INS will give the approve after SEP 15 2004,
