Plan to apply for H1 visa in Shanghai? Need help?

I-140 approved, I-485 not file yet. Plan to take 10 days vacation to visit parents... (My parents can not take long time flight, so they can not come here to see me.) Can I apply for H1 visa to come back to US? If so, how long will it take? I think they will suspect my immigrant tendancy, since my I-140 approved, also I got married early this year, my hu*****and is citizen. Please advise. Thanks!
