小白兔急問交485時的身份問題

J1已經豁免，EB1A140已經批準，但是雇傭合同在9月30日結束，如果485隻能在10月1日重新有名額之後遞交的話，身份會有問題嘛？該如何解決呢？謝謝回答！！！！！！！！！！！！！！！！！！！！！
