h1b pending, Should I apply H4 now?

4月份遞的h1b, 現在還沒批，昨天接ＵＳＣＩＳ通知，因為律師把公司地址寫錯了，要我補交材料，而且有可能不批，　宛如晴天一個霹靂。我現在處於OPT grace period ，八月中旬到期。讓律師補交材料後，老公律師建議我立即申請ｈ４．可聽說交了ｈ４後，Ｈ１就作廢了。我想等Ｈ１的結果，在考慮申請Ｈ４。可聽說，如果ｈ１被拒，我要馬上離境，　現在我都不知道怎麽辦好了。請各位好心人幫幫忙。
