1. unless you file your H extension now and request for premiume processing in order to get the approval before you leave in August. you cannot leave the U.S if your H extension is pending.

2. or you do not file the extension before you go instead you can file the extension after you come back in December.

3. your current H valid till Feb. 2008, this will not be the problem for you to apply for H visa. Just remember to ask your employer to issue an up-to-date employment varifiction letter and it should indicate to continue to employ you in the letter.

4. if you get H extension approval before you leave, you can only use your current H approval (expires in Fe. 2008) to apply for H visa. You can show your extension approval to the consul though. But remember when you enter the U.S., you MUST show BOTH current H approval and extended H approval to the inspector in order to get your I-94 stamped till the new extended period. If you only show your current H approval you will get your I-94 stamped till Feb. 2008. Then you have to file H extension again.
