請問專家NIW140填表

I am postdoc research fellow. There is question in I-140: "Is this position permanent?" My lawyer filled "Yes". I can not get a job letter to show this position is permanent. In fact, it is not permanent. Do you think it is fine to check "Yes". Thank you very much!
