Please help - Wise to change EB3 to EB2

Dear Bro and sis,

My EB3 PD is Aug-2005. Already have a master degree. Afraid of possible backlog again. Obviously EB2 is safer. But my lawyer said it unnecessary to spend money on EB2, since my PD is very early. Should I listen to him? What is the possibility of EB3 backlog prior to Aug-2005?
