Analysis: June I-485 Filers without Receipt



Many people who filed between June 10 and June 30 still have not got their receipts. AILA, in announcing its intention to litigate, alludes to the possibility that these applications will also be returned unprocessed due the unavailability of visa numbers. If the recent H1B rush is any indication, there is serious concern that those people's applications will be rejected on the same grounds. FYI: most of those who filed before June 10 have got their receipts within two weeks (see www.trackitt.com).

The DOS revised visa bulletin is ambiguous on this point: it did not say whether they will honor the earlier cut-off dates.

One thing remains unclear (and this is a technial point): if USCIS did not open those applications filled between June 10 and June 30, will they be considered "received" in June? Of course, if you ask USPS, it will say yes. But will USCIS say "yes" to too?

What's your take on this?
