Thanks for your reply. But HR says that OPT don't have to pay ss and mediacre ONLY if I stayed in U.S. less than 5 years, which I am not. Under your quote, "... However, if an alien is considered a resident alien, that pay is subject to social security and Medicare taxes even though the alien is still in one of the nonimmigrant statuses mentioned above.", does that mean what the HR people is talking about? In other words, if I've stayed for more than 5 years, I am subject to pay those taxes even when I am holding OPT?
BTW, if they won't refund me, is there anyway I can get it back from filling our tax forms?
