Check the tax return instruction. H-1B is considered resident alien and should pay tax. My employer made a mistake not taking tax off my paycheck a few years ago and had to go through a lot of hassle to correct it and recollect the tax. You probably want to pay to ask a professional account if you don't believe this. Good luck.
