My wife currently hold F-1 and will graduate in this Fall, and she will apply OPT on August. But I plan to file I-140 and I-485 con-currently (NIW) recently. I know I-485 will let her OPT denied. So my question is:
1. If we file I-140 together,
- Being considered as your dependent, your wife does NOT file I-140.
and If I file I-485 first without my wife, is there any negative effect for her to apply OPT?
-
If she can apply I-485 with me latter after she get OPT approval, is there any effect for our I-485?
- No
2. She earned first master in accounting but did not apply OPT, and now toward second master in finance which will graduate in this fall. Can she find accounting job during OPT? I know accounting and finance is very close, but still have difference.
- Technically NO. Accounting Opt was only available within 30 days (as I could recall) after her 1st graduation, and she needs to apply Finance OPT within 30 days of her current graduation. Practically, it is hard to tell whether the job is related to Accounting or Finance. So I would not say no.
