Xiaobaitu and 各位大俠, may I transfer back to industrial H1B?

I was once hired on industrial H1B visa, currently I am on academic H1B. My question is if I will be hired by an industrial company, can I resume industrial H1B without being restricted by the industrial H1B cap (which was already reached by july)?
