關於opt h1 pending file 485的問題

我ld現在是opt,h1的I94已經拿到了，就等10/01生效，我現在可以file 140/485，我問了我的律師，文對我ld有什麽影響嗎？這是他的回信，Although CIS regulations do not have an absolute prohibition against filing an adjustment of status application as an F-1 student, these individuals are required to maintain nonimmigrant intent (i.e. the intent to return to your home country after your temporary stay in the US) as a condition to maintaining status. Filing an adjustment application is clearly in conflict with the nonimmigrant intent requirement. This, coupled with the fact that adjustment of status is a discretionary benefit, means that filing an adjustment as an F-1 student would be extremely risky.

他還說，The most likely impact would be that your hu*****and's adjustment of status would be denied.
大家的律師有這樣說嗎？聽起來，好像極有可能被拒，這種可能性大嗎？如果他的case被拒了，他以後還能以自己的h1來FIEL GC嗎？
