The $5000 exemption usually applis for student on F-1 visa. It is for 5-year. However, you can take this exemption after 5 years as long as you can establish a close relationship with your home country. Say you send IRS a statement stating you don't want to stay in US permanently and will go back to China when you finish your study here. But it is no kidding. If you later on decide to apply for green card, your application will be denied based on the statement you provide to IRS. If you change to H1 visa, you can't take this exemption anymore even if you have been here less than 5 years. You may read IRS pub 519 for your own reference.
