the lc substitute is good exmaple. everyone knows most labor sub cases are fraud but since it is the law, dol and cis still allow these fraudest to obtain gc, until now, the law is changed to plug the hole. but the sub filed already will still go through because it is the law.

yes, the indian captured many h1 quotas, they got them even though there might not be a real job. why? because it is the law. the indian companies follow the law exacly. DOL/CIS can not catch them even though they know it they have to issue H1b to them.

the gc applicant does not work for the sponsor until gc is approved is the way the legislation intended how it works. cpt/opt, h1b are the "creative way" people use to work around the law by "creating" a temporary job for the understandable reason that the gc process is long. dol/cis have to allow it because the sponsor can have a temp job and a perm job they happen to have the same job functions. it is the sponsor's business. dol/cis has nothing to do with it they have to allow it.

Now you are saying genuinely following the law (don't work until getting gc) is fraud, or suspecious of fraud, are you nuts? if you are, cis is not.

responsibility of filing tax is checked at N-400 stage. has no business in 485 stage. you send tax return with 485 only when affidavit of support 864 is required. the tax return/w2/1099 is to verify your income, as supporting docs for 864. not for purpose of checking to make sure you file tax return every year. you will be checked on this at n400 stage.

as I said before, lawyers want you send paystub for the purpose of demonstrate you have maintained your h1b status (paystub will show you are not benched, you are working the correct hours and for the correct h1b sponsor). It is not for income verification.

Think this way: why don't the lawyers want your 1099? if it were for income verification, you have to turn in 1099, because for income a substantial part or all of income can be on 1099, and you can have no paystub or w2 - you can live on and support your family wholy on interest and dividend.
