My suggestions:
You need to act FAST! Out of status is no fun if USCIS cares, even several days!
If you are found to be out of status now, there is no way you can file 485 even you are current.
Your best chance is to get your H1 or your hu*****and get a new job asap, however, H4->H1 will require your hu*****and lastest payroll, so don't wait too long, use PP if possible, so that both of you can be in status.
Once you got your H1, your hu*****and can get H4 and get some breath for H1 again. Once he lands on new job, he can keep the PD of the currnet 140, provided the company doesn't revoke it, so that he can file another 140 while still have 01/27/06 as PD.
